Redundant Reformation

“The laws that forbid the carrying of arms are laws of such a nature. They disarm only those who are neither inclined nor determined to commit crimes…. Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man.”

– Thomas Jefferson, Commonplace Book (quoting 18th century criminologist Cesare Beccaria), 1774-1776

As I explained in Magic Omnibus, The Draconian NICS Denial Notification Act has become law. The ATF and Attorney General endowed with unrestrained deputization is far reaching and unfettered. Our enumerated right of self-defense while bearing arms has become ever more difficult to maintain. One might simply believe that public servants in Washington D.C. have aspirations of an unarmed population.

March 17th 2022, 40 members of Congress attempt at urging senate minority leader, Mitch McConnell, to "rally his caucus" in support for even more NICS reform. A year prior, March 11th, 2021, The House of Representatives passed both the Bipartisan Background Checks Act, H.R. 8 and the Enhanced Background Checks Act, H.R. 1446. After passing through the House, Senate majority leader Chuck Schumer boldly stated,

“Passing commonsense gun safety legislation has been a top priority of mine for as long as I’ve been in Congress. In the 25 years since I helped write the Brady Bill, Congress has not passed an overhaul of our background check system. That is why I am so proud to see the House pass this critical legislation that will take the long-overdue step of closing dangerous loopholes in the existing background check system to help keep all of our communities safe.

For years, Republican Leader Mitch McConnell let the incredibly popular background checks legislation languish in the Senate without a vote. Now, with Democrats in the Majority, the Senate will finally have the opportunity to act on this critical issue. When I bring commonsense gun safety legislation to the Senate floor, my Republicans colleagues should support it.”

However, both Acts have strangely enough languished in limbo. Why a year later ask to rush the process? Political implication simply answers that question. Implied that "We tried to pass common sense reform," “the bills were held back because of the filibuster,” "Republicans blindly followed the gun lobby." Virtue signaling for campaign strategies.

Bipartisan Background Checks Act of 2021 would require a Federal Firearms Licensee to run a NICS check for any and all firearms sales nationwide as a federal mandate. State to state the current laws vary, however only 9 states and D.C. have BBCA type legislation. "Universal Background Checks" because 41 states currently have a supposed elevated risk in sales of firearms for criminal activities. Never mind the 9 states that have already mandated severe restrictions still report the majority of homicides, it's "common sense" to prohibit the entire country.

The Enhanced Background Checks Act would extend the amount of time an FFL must wait to receive a check prior to transfer. The current period of time is 3 days and EBCA will extend the time to 10 days, some cases to 30 days or indefinitely. An attempt to close the so called "Charleston Loophole," where the FBI failed at properly vetting a criminal, allowing Dylan Roof to purchase a firearm used to murder innocent people. Roof had multiple drug related charges, easily considered a habitual addict and should have failed his NICS check. As usual criminal actions motivate politicians to infringe further into the Second Amendment guarantees. The Right to Bear Arms, not Maybe If We Deem You Worthy, after a fallible system of checks and undetermined amount of time.

As one of many thousands of people who have been NICS denied, these further attempts at quote "Reform" are disconcerting at the least. I was supposed to be prohibited, falsely determined by another Rufus' fingerprints. Had the FBI been given yet more days to "search," who knows the erroneous designations that could be fabricated. This common nonsense is likely to empower the DOJ with an interminable amount of time to control, criminalize, delay or decline every firearm purchased nationwide. So according to gun control advocates, enforceable mandatory background checks, criminal investigations, exponentially more federal officers and attorneys with unlimited time and funding are actually going to stop those of villainous intentions. As we have already witnessed, reported on and have seen daily, criminal behavior inherently does not abide any law. Crime appears to yield more government, greater taxes and manipulative control.

“The ultimate authority...resides in the people alone...The advantage of being armed, which the Americans possess over the people of almost every other nation...forms a barrier against the enterprises of ambition.”

-James Madison
