Red Flag Fallacy

"There are more instances of the abridgment of the freedom of the people by gradual and silent encroachments of those in power than by violent and sudden usurpations."

James Madison

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized, this is the direct text of Amendment IV to the Constitution of the United States of America. Amendments V and XIV deal specifically with "equal protection of the laws", "nor shall any state deprive any person of life, liberty, or property, without due process of law,". Having first-hand experience with a tyrannical government from dealing with King George III, prior to ratification Jefferson had written Madison stating,

"A bill of rights is what the people are entitled to against every government on earth."

When Red Flag warrants or Extreme Risk Protection Orders are enforced the aforementioned citizen’s, rights have been infringed upon. The recipient has no prior notification, no "day in court", and no recognition of whom is the accuser. Langley Outdoors Academy has on multiple occasions vlogged about these laws and oftentimes their outright failure. I briefly spoke about this failure in "Groucho and ERPO Marxism” and have shown that a full third of orders are falsified. Nonetheless there are Nineteen states with some form of Red Flag legislation.

When more than one third of our country’s states have legislated control laws that are blatantly Unconstitutional wouldn't there apparently be the promised outcomes? In truth, no they have not. Yes, thousands of citizens have been subjected to "risk" search and seizures, five thousand of them in 2020 alone. Though the seizures have commenced, the criminal has not been abated whatsoever. Americans are being stripped of their inherent right to due process derived by some persons "higher morality". Which persecuting persons that may be, does vary greatly from state to state, may be a family member, a former spouse, girlfriend or boyfriend, a medical or law enforcement professional or even a teacher, counselor or principal. Any of whom might petition the court in pronouncement of their believed virtue. No verdict by twelve peers, rather an extremely subjective and probably opinionated directive. Of these directive Unconstitutional warrants, a full third are proven to be false.

The falsified warrants still having had the accused subjected to search, seizure and litigation are happening 33% of the time and without equal ramifications brought to their accuser.

I stated that risk warrants are not stopping criminals effectively. Just look at the recent shootings for proof as such. Every state these tragedies have occurred already have some form of Red Flags, and they are failing to prevent individuals who already have criminal tendency. I plan in-depth and specific study of these recent mass homicides, state to state. As follows is reinforcement and affirmation to the inefficiency of risk warrants.

Robert Crimo in Highland Park, Illinois was known to the FBI and law enforcement before the 4th of July 2022 parade incident. Crimo had multiple knives, a dagger and sword confiscated from his possession. This stemmed from threatening violence to his family and or to commit suicide in 2019. Yet he was able to obtain the Illinois FOID card, pass stringent licensure and background checks to purchase a firearm. The 2022 Buffalo, New York shooting perpetrator, Peyton S Gendron had been "investigated" for threatening to kill his fellow students and committing suicide in June 2021. Gendron even bragged about "bluffing" the police and doctors online thereafter being released.

Anderson Lee Aldridge of Colorado Springs, Colorado had been arrested in June 2021 for issuing a bomb threat against his mother. Aldridge refused to surrender resulting in a neighborhood evacuation during the "stand-off". Strangely enough is that this incident has been sealed and there were no charges filed against Aldridge. The charges that should have been enforced are, Felony Menacing and First-Degree Kidnapping.  Aldridge also in 2021 had to be banned from an airplane flight after insulting passengers and harassing crewmembers. He was filmed during this incident and caught stating, "I wish I could shoot all of you!"

University of Virginia shooting, November 2022 perpetrator Christopher Darnell Jones Jr., had been involved in a "concealed weapon" violation in February of 2021. It was also known that Jones had made comments about owning a gun which was under some form of "investigation" through UVA Student Affairs in September 2022, stemming from Jones' response to having been hazed and bullied.

Beforehand, these four criminals clearly had shown blatant signs, red flags if you must, the portent of committing heinous actions. In every instance something or someone failed, no matter the volume of virtue signaling. The mental health of these individuals as a common thread is, for the most part ignored by the media and political figures yet speaks volumes.

Giving any accountability to a possible disgruntled spouse or neighbor, while positioning zero accountability to the grossly bureaucratic nature of law enforcement, irrefutably derives a recipe for disaster. This current fashion towards "it's not the criminal’s fault" thus lessening the consequences must stop now. Nowhere is there a larger, ominous red flag than that.

"And that the said Constitution be never construed to authorize Congress to subject the people to unreasonable searches and seizures of their persons, papers or possessions."

  Samuel Adams.
